What is the purpose of the RTTL Organization? The RTTL Organization brings together individuals dedicated to creating a better future for our community. As the public interface for the Return to the Land private membership association, the organization aims to foster collaboration and development towards this goal. What is a Private Membership Association (PMA)? A private membership association (PMA) is an organization that operates privately and has membership-based access. By structuring ourselves as a PMA, we can achieve greater legal freedoms and reduce liability. We maintain a full PMA document that outlines our principles and guidelines.

Land Ownership and Management

How is land owned and managed in the Ozarks Chapter? The Ozarks Chapter has developed a unique form of land ownership similar to that of Orania in South Africa. We created a private neighborhood owned by the members of an LLC and managed according to the LLC Operating Agreement. Each member is allocated a piece of land according to their ownership percentage in the LLC. The LLC board is responsible for maintaining common property elements, while the LLC Operating Agreement specifies the rules and management procedures.

Am I required to develop my land within a certain time period? No, unless one of our group land buys adds a time-related stipulation to its operating agreement.

Are there zoning laws where the land is located? We have selected an area where no zoning laws or permits are required for construction, with the exception of state law requirements for septic systems.

Development Assistance

Can you help me with development? Some PMA members are contractors or have development experience. Contact us for details.

Septic and well costs? Expect about $7-$8k+ for a septic system and $9-$13k for a well. Alternatives and less expensive options exist; consult us for compliance and best practices.

Electric hookup? The cost can be around $30-$35 per foot to bring electricity from the nearest post. Contact us for detailed requirements and potential shared costs.

Internet access? Internet options vary by property; most areas offer fiber optic and 4G cell reception.

Employment and Skill Contribution

Is there work available on the land? Periodically, opportunities for paid work arise, requiring no construction experience—just willingness to learn. For more details, message @peterjcsere.

Land Ownership Transfer and Protection

Sale, Inheritance, or Seizure of your LLC Membership Interest? Your LLC share is transferable and adheres to inheritance law but is protected from complete seizure by creditors due to the LLC's multi-member structure and share transfer restrictions.

Can I be expelled from the land-owning LLC? Expulsion from the LLC is reserved for severe violations of the Operating Agreement. If expelled, you have the right to fair market compensation and possible legal recourse.

Is there an HOA fee? Each land-owning LLC has an initial development budget included in the share price. A yearly maintenance budget is passed by member vote, which may offer work exchange options for certain maintenance tasks.

Who governs the LLC? The LLC Board of Managers, elected every 2 years, is responsible for carrying out the operations as per the LLC Operating Agreement, which is governed by the Arkansas Uniform LLC Act (ULLCA). Mismanagement may lead to a vote for removal.

What happens during bankruptcy or creditor asset seizure? A charging order can be placed on your membership interest but cannot be seized outright, protecting the land under share transfer restrictions and case law.

What if the LLC is dissolved? If the LLC dissolves, the default action per the Operating Agreement would be for the land to pass to the owners as tenancy-in-common or parcellation.
